Terms of Service

These terms explain how Giftvera works and what we expect from each other. We wrote them in plain English. By buying or using a Giftvera gift, you agree to them.

Who we are

Giftvera ("we", "us") makes personal digital gifts: animated pages and small 3D worlds that you fill with your own words, photos and videos. You can reach us at [email protected].

What you buy

When you buy a gift, you get a private link to a gift made from the design you chose, with your words, photos and video. The gift stays online for the time you chose. Gifts open in a web browser on phones, tablets and computers. The 3D worlds need a fairly recent device.

A gift is a digital service. Nothing is shipped, and there is no file to download.

Who can buy

You must be at least 18 years old to buy a gift. If you are younger, a parent or guardian must make the purchase for you. The person who receives a gift can be any age.

Prices and payment

• Prices depend on the country you shop from. Everyone deserves to give a gift like this, so we set a fair, fixed price for each country. It is in that country's currency when our payment provider can take it, and in US dollars otherwise.
• The price on the page is the price you pay, with taxes included.
• Your country is worked out from your internet connection, and the bottom of the shop and of each design's page says which one it is. At checkout, your billing address must be in that country. We may cancel and refund an order paid at the prices of a country where the buyer does not live, for example by using a VPN.
• Adding time to a gift later uses the same country and currency as the purchase.
• Payments are handled by Dodo Payments, our online reseller and Merchant of Record. Dodo Payments processes your payment, handles taxes where needed, and its buyer terms also apply to your purchase. When a price is in US dollars, checkout may offer your local currency at Dodo Payments' own exchange rate.
• We never see or store your card details.
• Every payment is a single payment. There is no subscription, and nothing renews by itself.

How long your gift stays online

• Every gift includes 1 month online. At checkout you can choose 6 months or 1 year instead, for an extra price shown on the page.
• Later, you can add more time from My gifts: 1 month, 6 months or 1 year, at the prices shown on the design's page. A gift can be paid for up to 3 years ahead.
• About a week before your gift goes offline, we email you once so you can decide. You don't have to do anything.
• When the time is over, the link stops opening. Adding time is for gifts that are still online. An ended gift can be brought back from My gifts, on the same link, for the design's full price at that time, for as long as we still store it.

Your private link

Each gift has its own hard-to-guess link, and gift pages are hidden from search engines. There is no password: anyone who has the link can open the gift. Please share it only with the people you want to see it. We are not responsible for who sees a gift after you or they share the link.

Sending your gift

• You can share the link yourself right after paying, or choose a date and time and we email the link for you.
• A scheduled email can be set for at least 15 minutes after you pay, so there is time to finish paying first.
• Please check the email address, date and time before you pay. You can change the receiver's email address and the time from My gifts until 5 minutes before the email is sent. After that they are locked, because the email is on its way.
• Your own email address cannot be changed after you pay. It is how we send your receipt and your link to update the gift.
• Email can be delayed or filtered as spam by the receiver's email provider. If we cannot send a scheduled email at all, we tell you, and your link keeps working so you can send it yourself.

Changing and deleting your gift

• You can update your gift while it is online. Go to My gifts, enter the email you used when you paid, and we email you a link to update it. The gift link stays the same.
• You can also delete a gift from My gifts. Once deleted, the link stops working for everyone and the gift cannot be brought back, even if you contact us. See our Privacy Policy for what happens to the stored data.

Your content

Your words, photos and videos stay yours. You give us permission to store them and show them to the people who open your gift, only so we can provide your gift. We don't use them for anything else, and we never sell them.

You must only add content that you have the right to use. If your gift shows or names other people, make sure they would be happy with it. When you give us the receiver's email address, you confirm that you may share it with us so we can email them your gift.

You agree not to add anything that:

• is illegal, or encourages illegal acts;
• shows nudity or sexual content, or sexualises anyone under 18 in any way;
• shares private or intimate images of someone without their permission;
• harasses, threatens, bullies or hates on anyone;
• uses someone else's photos, music, videos or other work without permission;
• pretends to be someone else to mislead the receiver;
• contains viruses or harmful code.

To help keep Giftvera safe, we may use automated tools to check uploaded content for things that break these rules (see our Privacy Policy). If a gift breaks these rules, we may take it down without a refund, and we may report clearly illegal content to the authorities.

Report a gift

If a gift uses your photos, your name or your work without your permission, or breaks these rules in another way, write to [email protected] with the gift link and a few words about what is wrong. We look at every report, and we take down gifts that break these terms.

The 3D worlds

• Up to 4 people can be in a 3D world together at the same time.
• Chat and what happens in a room are not saved. They disappear when everyone leaves.
• Please be kind to the people you meet there.

The writing helper

Some designs offer an optional AI writing helper. It can make mistakes, so please read the text before you pay. You are responsible for the words in your gift, including the ones you chose from the helper.

Refunds

All sales are final. We only give a refund when a gift does not work because of a problem on our side that we cannot fix. The details are in our Refund Policy.

Your gift is made and goes online the moment you pay. By paying, you ask us to start right away, and you agree that a right to cancel within 14 days, where the law gives you one, ends when your gift goes online.

Keeping Giftvera running

We work hard to keep every gift online, but we cannot promise the service will never be slow or briefly unavailable, for example during maintenance or problems with the internet or our providers. If one gift is opened an extremely high number of times in a short time, we may pause it for a few minutes to protect the service; it then opens again by itself.

Our designs

The designs, pages, 3D worlds, code and artwork of Giftvera belong to us. Buying a gift lets you use it as a personal gift. You may not copy, resell or reuse our designs or code.

Limits of our responsibility

Giftvera is provided "as is". As far as the law allows, we are not responsible for indirect losses, and our total responsibility for any claim about a gift is limited to the amount you paid for that gift. Nothing in these terms takes away rights you have by law that cannot be taken away.

Misuse

If someone uses Giftvera to break these terms or the law, or tries to harm the service or other people, we may block their access and take down their gifts.

Changes to these terms

We may update these terms as Giftvera grows. The date at the top shows the latest version. If you keep using Giftvera after a change, the new terms apply.

If one part of these terms cannot be applied, the rest still applies.
